Theft
Section 4 of the Criminal Justice (Theft and Fraud) Offences Act 2001 states that an individual shall be guilty of theft where they have dishonestly appropriated property without the consent of its owner with the intention of depriving its owner of it.
Often, cases of theft will be dealt with in the District Court however the accused will be entitled to the right of election meaning they may elect to have their matter dealt with before the District Court or they may elect for the Circuit Court.

Burglary
Section 12 of the Criminal Justice (Theft and Fraud) Offences Act 2001 stipulates:
“12.(1) A person is guilty of burglary if he or she
(a) enters any building or part of a building as a trespasser and with intent to commit an arrestable offence, or
(b) having entered any building or part of a building as a trespasser, commits or attempts to commit any such offence therein.”
Similar to cases of Theft, individuals accused of Burglary will have the right of election i.e. they may elect for their case to be sent to the Circuit Court.
Aggravated Burglary
Section 13 of the Criminal Justice (Theft and Fraud) Offences Act 2001 stipulates that:
“13.(1) A person is guilty of aggravated burglary if he or she commits any burglary and at the time has with him or her any firearm or imitation firearm, any weapon of offence or any explosive”
Robbery
Section 14 of the Criminal Justice (Theft and Fraud) Offences Act 2001 stipulates that:
“14.(1) A person is guilty of robbery if he or she steals, and immediately before or at the time of doing so, and in order to do so, uses force on any person or puts or seeks to put any person in fear of being then and there subjected to force”.
