Possession Charges
Section 3 of the Misuse of Drugs Act states that an individual shall be guilty of an offence where they are found to have in their possession a controlled substance including:
Possession of a Controlled Substance with intent to Sale/Supply Charges
Section 15 of the Misuse of Drugs Act states that an individual who possesses a controlled substance for the purpose of selling or otherwise supplying it to another shall be guilty of an offence.
This can often be a very serious charge where given its serious nature, may be triable on Indictment/ in the Circuit Criminal Court however in some cases this type of offence may be tried summarily or before the Criminal District Court.
In determining whether this charge will be dealt with in the District Court or the Circuit Court, certain factors will be taken into consideration for example:

Cultivation/Growth of a Controlled Substance
Section 17 of the Misuse of Drugs Act states that an individual shall be guilty of an offence where there are found to have Cultivated/Grown a controlled substance i.e. Cannabis Plant or Opium Poppies.
Similar to the Sale/Supply Charge, this offence is also triable in the Circuit Criminal Court or in the District Criminal Court where factors are taken into consideration to determine which court the offence shall be dealt with in.
Garda Station Attendance
Very often it is advisable that a suspect is accompanied by a solicitor during a Garda interview. Advice should be sought on every occasion if asked to attend at a Garda Station for interview.
