Damage to Property

Section 2(1) of the Criminal Damage Act 1991 governs Criminal Damage where an individual who without lawful excuse damages any property belonging to another individual.

One’s property often refers to an object which is tangible in nature for example, buildings, Cars, Money and Animals.

Dangerous Damage to Property

Section 2(2) of the Criminal Damage Act 1991 relates to damage to property which may result in the endangerment of another person.

Arson

Section 2(4) of the Criminal Damage Act 1991 relates to the damage of property by Fire.

Threat to Damage Property

Section 3 of the Criminal Damage Act 1991 relates to the making of threats to cause damage another’s property.

Section 3 of the Criminal Damage Act provides:

S.3 – A person who without lawful excuse makes to another a threat, intending that that other would fear it would be carried out—

  • to damage any property belonging to that other or a third person, or
  • to damage his own property in a way which he knows is likely to endanger the life of that other or a third person, shall be guilty of an offence

Possession with Intent to Damage Property

Section 4 of the Criminal Damage Act 1991 relates to the possession of anything with the intent to damage property of another/ or where the accused knew that they were likely to endanger the life of another shall be guilty of an offence.

Section 4 of the Criminal Damage Act 1991 states:

“4.A person (in this section referred to as the possessor) who has any thing in his custody or under his control intending without lawful excuse to use it or cause or permit another to use it—

(a) to damage any property belonging to some other person, or 
(b) to damage his own or the intended user’s property—
    (i) in a way which he knows is likely to endanger the life of a person other than the possessor, or
    (ii) with intent to defraud,
shall be guilty of an offence.”
